NEWS / Queensbury Resident Indicted on Transporting a Minor ChargeDefendant Alleged to Have Transported a 14-Year-Old Girl from Vermont to Queensbury, New York while Intending to Engage in Criminal Sexual Activity with the Child ALBANY, NY—United States Attorney Richard S. Hartunian and Clifford C. Holly, Special Agent in Charge, Federal Bureau of Investigation, Albany Division, announce the filing of an Indictment charging ANDREW BENWAY, age 24, of Troy, New York, with transporting a minor in interstate commerce with the intent to engage in criminal sexual activity, in violation of Title 18, United States Code, Section 2423(a).1 Count 1 of the Indictment charges that between about April 8, 2011 and May 7, 2011, BENWAY transported a 14-year-old girl from Vermont to his residence in Queensbury, New York with the intention of engaging in criminal sexual activity with the minor female. If found guilty of count one, the defendant faces a statutory maximum sentence of life imprisonment, with a mandatory minimum sentence of 10 years, and a maximum fine of $250,000.00. BENWAY was arraigned on the charges in Albany on August 5, 2011 before the Honorable David R. Homer, United States Magistrate Judge. BENWAY was released pending his trial scheduled for October 3, 2011 before the Honorable Gary L. Sharpe. This case was investigated by the Federal Bureau of Investigation and the Warren County Sheriff’s Office. This case is being prosecuted by Assistant United States Attorney Rick Belliss. 1 The charge is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
